NewResilience, Continuity, the Pro levels and Agentic Verification: from safekeeping to proof you can recover. The new line-up is here.See what's new
A form page, so the form sits in the hero. Production's /create-custom-software-escrow-agreement is a heading, one sentence and a multi-step HubSpot form ("Your progress 0% completed"). The sentence is kept in substance: "Our legal team will review your information and send you a draft agreement that you can modify as needed." The page around the form now explains what you'll receive and what happens next, so the request feels safe to send.
  • The fields are designed for this kit, because production's HubSpot form fields weren't captured. They ask what legal needs to start a draft: who you are in the agreement, the structure, the application type and your starting point. Match the HubSpot form when this goes live (production's is multi-step; this one is a single step).
  • Production claim, flagged: "our legal team" drafts and reviews (to-confirm.md lists "Drafted by our legal team"). Production's /escrow-agreement also promises agreements "in under 24 hours" and /switch-to-codekeeper "within one business day". Neither is stated here; add one if legal confirms a standard.
  • Production's trust row shows "ISO 27001 SOC 2 ISO 22301" badges. Only ISO/IEC 27001:2022 is confirmed, so only that is claimed.
  • No offer band on this form page; the final CTA carries both buttons.
  • "Trusted by 3,500+ teams" is production's figure (MESSAGING §6), used unflagged as on the home page. Confirm it with the other production claims in to-confirm.md.

This is where your request would go to our legal team.

This is an example page, so nothing was sent. In production this HubSpot form sends your details to the legal team, who reply with a draft agreement.

What happens after you submit, so nobody wonders. Four steps from production's own process, with no new promises. Step 1 is the production page's sentence. Step 3 is production FAQ ("Download the agreement we generate, mark it up in Word or PDF, and upload it for our legal team to review"). Step 4 is production FAQ too: signing outside the dashboard by email or PDF, and "Deposits open once the agreement is signed". Legal to confirm the "legal team" wording and whether a standard turnaround can be stated.

After you submit

From your answers to a signed agreement.

You see every draft, and nothing is final until every party signs.

1

We review your details

Our legal team reads your request and gets in touch if anything needs clarifying, such as the parties or the release conditions.

2

You receive a draft

We email you a draft agreement based on your answers, on our template or yours.

3

Mark it up

Download it, mark it up in Word or PDF and upload it. We review every change your lawyers propose.

4

Sign and deposit

Sign in the dashboard, or by email or PDF if you need to. Deposits open once the agreement is signed.

What a custom agreement settles, in one box. Buyers and their lawyers want to know what the draft will contain before they ask for it. Every item comes from the production FAQ or the confirmed facts: the three structures, "whatever it takes to rebuild and run the application", the common release conditions, the release process (from the Trust Center FAQ) and Agentic Verification with Escrow Pro. Governing law is flagged: production offers "your choice of governing law and storage jurisdiction", which to-confirm.md lists as open. The callout repeats the agreed line: the Recoverability Certificate doesn't grant release rights.

What the agreement sets out

Clear terms, agreed before you need them.

Every Codekeeper escrow agreement answers the same questions. A custom one answers them for your situation.

Parties
The vendor (depositor), Codekeeper and, in three-party and multi-party agreements, each beneficiary
The deposit
Whatever it takes to rebuild and run the application, listed in the agreement
Release conditions
For example insolvency, a failure to maintain or support the software, or a breach of contract
Release process
We verify the condition and authenticate the beneficiary before anything is released
Proof
A Software Resilience Certificate, and with Escrow Pro, rebuilds by Agentic Verification
Governing law
The jurisdiction you choose
Release rights come from the agreement. The Recoverability Certificate documents a rebuild and its result. It doesn't grant release rights; the agreement does.

The questions legal and procurement ask before they send the form. The lawyer answer replaces production's "No. Codekeeper provides the legal framework… You don't need outside counsel unless you prefer it": it keeps the substance without telling anyone not to take legal advice. The price answer uses the 6 Oct list; sales to confirm whether a custom draft carries any extra fee (none is stated on production). The timing answer states no time, until legal agrees one.

Questions

Before you request a draft.

Do we need our own lawyer?

That's your choice. Our legal team prepares the draft for the structure you choose and reviews any changes your lawyers propose.

Can we use our own template?

Yes. Choose "Our own template" in the form, or email it to contact@codekeeper.co. You can also mark up ours in Word or PDF.

Which structures can we choose?

Two-party agreements between the vendor and Codekeeper, so protection can extend to any client who asks. Three-party agreements that name one beneficiary. Multi-party agreements that name several, each with its own release conditions.

How long does it take?

It depends on the structure and the number of parties. We'll tell you when to expect the draft once we've read your request.

What does it cost?

Escrow is from $199 and Escrow Pro from $449 per application per month, with setup at $499 per arrangement. Enterprise: talk to us for a quote. See pricing

We already have an escrow with another provider.

We can move it. Send us the agreement you have today and we'll plan the switch with you. How switching works
